Monday, June 22nd, 2009Hi, the real answer is dependant on both your state and lender. For example, in California, we are a trust deed state and therefore, the lenders are not able to get judgements against us should they take a loss on the foreclosure. Their only recourse, should they use it, is to report the loss to the IRS by doing a 1099, in which you have to pay taxes on the money lost.
It is dependant on your lender as to what they do based on state laws and the options available to them, such as if they were able to recover the loss by their insurance.

Rental Home In Foreclosure When Do I Move Out?
Sunday, June 21st, 2009The rental home I’m in is in foreclosure and scheduled for sheriffs sale in 3 weeks. The owner has plead guilty to mortgage fraud in relation to his mortgage business he was in.
He is pending sentencing. I know this guy is not going to retain this house. At what point is my lease dead? After the sheriffs sale? or After a redemption period? (5 wks or 6 months)
Also, If I’m in the house up to the very last day prior to the bank changing the locks, what if the owner wants to clear it out like he has stated to me. HE wants to come in and take all the appliances, wants to pull out toilets, sinks, lighting, basically he told me when he loses the house he is leaving walls for the next owner/bank. Can he do that? Should I let him in?
Home In Foreclosure, Moving To Another State, What Are The Chances They Will Try To Collect Shortage?
Monday, June 15th, 2009I’m from MA, moving back there after losing my home in RI. I know that MA has a provision to prevent recovering shortages on foreclosure sales. I don’t think that exists in RI. As a MA resident, will they be able to pursue me there for judgment? What is the likelihood they would try to recover when I have no assets, no property and very poor credit. Thanks.
How Do I Get In On The Foreclosure Home Action?
Friday, June 12th, 2009I live in South Carolina and would love to know if there are any decent foreclosure homes in my area. But everytime I try to look something up online (Hud, etc.) they want a fee or a free trial… provided I give them my credit card number. Is there a bank I could contact, or maybe police auction?
